State and Local Agencies Can Supplement Monitoring Requirements in Title V Permits
In an August 19, 2008 decision, the U.S. Court of Appeals for the District of Columbia Circuit (DC Circuit Court) vacated EPA’s 2006 rulemaking that prohibited state and local agencies from supplementing monitoring requirements in CAA Title V operating permits (Sierra Club v. EPA, No. 04-1243 (D.C. Cir. Aug. 19, 2008).
