Health Insurance Benefit Coverage Law
Under the Health Insurance Act of 2003 (Ch. 673 (S. 2), L. 2003, enacted October 6, 2003), certain employers would have been required to provide health insurance to their employees as a benefit starting in 2006. The law was put before California voters on November 2, 2004, however, and the legislation was rejected, thereby negating its effect (Proposition 72, November 2, 2004).

Minimum Wage Law
On November 2, 2004, Florida voters approved a measure that establishes a state minimum wage of $6.15 per hour, to be effective six months after enactment.

Preemployment Inquiries Law
Background check provisions relating to certain school workers have been amended (Ch. 2004-295 (S. 2986), L. 2004).

Minimum Wage Law
Until April 30, 2005, the living wage rates for Washtenaw County are as follows: $9.42 per hour with employer-provided health care benefits, and $11.06 per hour if the employer does not provide health care benefits.

On November 2, 2004, Montana voters approved a medical marijuana law. The law does not, however, require employers to accommodate the medical use of marijuana in any workplace (Initiative No. 148).

Minimum Wage Law
In the November 2, 2004, general election, Nevada voters approved a ballot measure to increase the minimum wage through amendment of the Nevada Constitution; however, Section 2 of Article 19 of the Constitution requires such an amendment to be approved one more time by voters in 2006 before the measure can take effect. Nevada voters said "yes" to Ballot Question No. 6, which calls for a new section to be added to Article 15 of the Nevada Constitution that would require employers to pay $6.15 an hour to employees if the employer does not provide health benefits, but would require the employer to pay employees $5.15 an hour if health benefits are in place. The measure also calls for the minimum wage rate to increase along with any increases in the federal rate over $5.15 an hour or, if greater, by the cumulative increase in the cost of living as measured by the Consumer Price Index (Ballot Question #6, November 2, 2004).

Preemployment Inquiries Law
The state's background checks law has been amended with respect to certain people who work with children (H. 106, H. 117, and H. 306, L. 2003).

Criminal Background Checks Law
Persons having contact with children, mentally disabled and elderly are required to submit fingerprints and undergo a criminal records check. Title 1, Chapter 109, Section 109.572, as amended by H.B. 306, L. 2003, effective July 23, 2004 and H.B. 117, L. 2003, effective Sept. 3, 2004. ¶36-23,600.11.

Criminal Background Checks Law
The law pertaining the employment of employees in foster homes has been amended. Title 21, Chapter 2151, Section 2151.86, as amended by H.B. 117, L. 2003, effective Sept. 3, 2004. ¶36-23,600.31.

Family, Medical and Parental Leaves Law
State employees may use compensatory time to account for authorized absences covered by the federal Family and Medical Leave Act of 1993 (S. 1385, L. 2003).
